All parking at 6415 Mesa Dr, Houston, Texas 77028 is provided strictly on an "AS-IS" basis and at the licensee's sole risk. Mesa Truck Parking, LLC assumes no liability for theft, loss, damage, vandalism, fire, flooding, weather events, collisions, or the criminal acts of third parties. No warranty, express or implied, is made regarding the safety, security, or condition of the premises or any vehicle, trailer, cargo, or equipment stored thereon.
No Bailment Relationship
Parking at the property grants a temporary, revocable parking license only. It explicitly does not create a lease, tenancy, or bailment relationship. Mesa Truck Parking, LLC never takes custody, possession, or control of any vehicle, trailer, cargo, or equipment. The parker retains full responsibility for and custody of all property at all times. No employee, agent, or representative of Mesa Truck Parking, LLC is authorized to accept custody of any vehicle or property on behalf of the company.
Operational Security Only
On-site security measures, including fencing, lighting, gates, or video cameras, are maintained solely for the operational benefit and protection of the property itself. These features do not constitute security services for the parker, do not guarantee safety, and do not establish an implied duty to protect any vehicle or its contents. Video recording systems may be offline, malfunctioning, obstructed, or unmonitored at any time without notice. Mesa Truck Parking, LLC makes no representation that any security system will prevent theft, vandalism, or unauthorized access.
Statutory Tow-Away Zone — Texas Occupations Code § 2308.251
This property is a designated Tow-Away Zone pursuant to Texas Occupations Code § 2308.251. Any vehicle parked without a valid, active reservation; left on the premises beyond the paid term; deemed abandoned under applicable Texas law; or actively leaking fluids is subject to immediate towing, relocation, or storage at the vehicle owner's sole expense. Mesa Truck Parking, LLC assumes no liability for damage incurred during towing or impoundment. All towing charges, storage fees, and administrative costs are the sole responsibility of the vehicle owner.
Terms of Use & Binding Agreement — Implied Consent by Entry
Entering, accessing, staging, or parking any vehicle on the property constitutes immediate and irrevocable acceptance of the complete Terms and Conditions of Mesa Truck Parking, LLC, regardless of whether a physical signature is provided. Clicking "Accept Terms and Conditions" online or utilizing gate access credentials serves as conclusive evidence of a legally binding agreement. No additional handwritten or electronic signature is required for full enforceability. These terms are binding on the vehicle owner, operator, lessee, and any other party with an interest in the vehicle or cargo.
Limitation of Liability
To the maximum extent permitted by applicable law, Mesa Truck Parking, LLC, its members, managers, employees, agents, and successors shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of this facility, including but not limited to loss of vehicle, trailer, cargo, or personal property; loss of business income; or personal injury. In no event shall the total liability of Mesa Truck Parking, LLC exceed the amount paid by the parker for the specific reservation period during which the claim arose.
Governing Law & Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or related to the use of this facility shall be resolved exclusively in the state or federal courts located in Harris County, Texas. By using this facility, the parker irrevocably consents to the personal jurisdiction of such courts.
Facility Rules
Operational facility rules — including license plate pre-registration, bobtailing policy, landing gear requirements, trash disposal, and hazmat compliance — are posted at the facility entrance and on the Mesa Truck Parking homepage.
